Terms & Conditions (T&Cs) – House of Harrold

1. Scope
1.1. These Terms & Conditions (T&Cs), also referred to as our General Terms and Conditions (GTC), apply to all orders and contracts between House of Harrold (“we,” “us”) and consumers (§ 13 BGB) through our online shop www.houseofharrold.com.
1.2. A consumer, for the purposes of these T&Cs, is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
1.3. Deviating terms from the customer are not recognized unless we expressly agree to their validity in writing.
2. Contract Language and Storage
2.1. The contract language is German or English, depending on the selection in the online shop.
2.2. We do not store the contract text permanently. The order details and these T&Cs will be sent to you via email. Registered customers can view order details in their account.
3. Offers and Conclusion of Contract
3.1. All offers in our online shop are non-binding and subject to change.
3.2. By clicking the “Pay Now” button, you submit a binding offer to conclude a purchase contract.
3.3. Receipt of the order will be confirmed by email. This order confirmation does not yet constitute acceptance of the offer.
3.4. The contract is only concluded when we accept the order through a shipping confirmation or by delivering the goods.
3.5. Orders are only permitted for private use. Commercial resale is prohibited.
4. Prices and Shipping Costs
4.1. All prices include the applicable statutory VAT.
4.2. Shipping costs are displayed separately during the order process.
4.3. The price at the time of the order applies.
Deliveries to countries outside the EU
For deliveries outside the European Union, additional import duties (e.g., customs, taxes, or other fees) may apply. These costs are generally borne by the customer.
Exception: Deliveries to the United Kingdom
For deliveries to the UK, we offer DDP (“Delivered Duty Paid”). In this case, we cover all import duties, and the customer incurs no additional costs. UK VAT will be indicated on invoices according to our UK VAT registration.
Note: Import duties vary by country. For non-EU countries where we do not offer DDP, we recommend customers consult the relevant customs or tax authorities regarding possible fees.
4.5. Discount Promotions (Sale)
4.5.1. From time to time, we may offer special promotions (“Sale”) with reduced prices.
4.5.2. Sale promotions apply only for the period specified in the online shop and while stocks last.
4.5.3. Sale prices apply only to end-customer orders and cannot be applied retroactively to previous orders.
4.5.4. We reserve the right to change or end Sale promotions at any time.
4.5.5. Price changes only affect future orders; completed orders are charged at the price valid at the time of the order.
4.6. Promotions and Voucher Codes
4.6.1. Newsletter subscribers or other customer actions may receive voucher codes or discounts (“Promotion”).
4.6.2. Promotions are generally one-time per customer, non-transferable, and cannot be combined with other discounts unless explicitly stated.
4.6.3. Promotion discounts apply only to the specified order, products, or categories as described in the respective promotion.
4.6.4. We reserve the right to change, suspend, or terminate promotions at any time.
4.6.5. We may, from time to time, offer free delivery as part of promotional campaigns, subject to change.
5. Delivery and Product Availability
5.1. Delivery times are specified during the order process.
5.2. Ordered goods will be shipped to the delivery address provided by you. Please ensure the address is complete and correct. We are not responsible for delivery delays or failures caused by incomplete or incorrect information.
5.3. Partial deliveries are permitted if reasonable for the customer.
5.4. If a product is unavailable due to no fault of our own, we reserve the right to withdraw from the contract. Payments already made will be refunded immediately.
5.5. The risk of accidental loss or deterioration of goods passes to consumers only upon handover of the goods to the consumer or a person designated by them (§ 475 (2) BGB).
6. Payment Terms
6.1. Available payment methods are shown during the order process.
6.2. The purchase price is due immediately upon conclusion of the contract.
7. Right of Withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our separate cancellation policy.
8. Retention of Title
8.1. The goods remain our property until full payment is made (§ 449 BGB).
9. Warranty (Statutory Rights for Defects)
9.1. Statutory Rights
Statutory warranty rights apply in accordance with §§ 437 ff. BGB. Your statutory rights in case of defects remain unaffected and can be asserted free of charge.

9.3. Inspection of Goods
Please check the delivered goods immediately for completeness and obvious defects. Report defects promptly to facilitate processing.
10. Liability
10.1. We are fully liable for damages from injury to life, body, or health.
10.2. For other damages, we are fully liable in cases of intent and gross negligence.
10.3. For simple negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability is limited to the typical, foreseeable contractual damage.
10.4. Liability under the Product Liability Act and guarantees remains unaffected.
11. Applicable Law
11.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2. For consumers residing in another EU Member State or the UK, mandatory consumer protection provisions of that state remain unaffected.
12. Jurisdiction
12.1. For consumers, the statutory place of jurisdiction applies.
12.2. Lawsuits against consumers must be filed at their place of residence.
13. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Social Media Policy
We welcome customer posts featuring our products.
14.1. Use of Posts
By tagging our products on social media (e.g., @houseofharrold) or using hashtags #houseofharrold, #madeforbetterwalks, you voluntarily grant us permission to share your post on our social media channels.
14.2. Withdrawal
You may revoke this consent at any time by sending a short message to support@houseofharrold.com. Upon receipt, we will remove the post as soon as possible.
